1. Overview
Please read these Terms and Conditions carefully before using our website https://skippercheck.net/ (hereinafter – the website).
By visiting our website and/or purchasing something from us, you engage in our “Service” and agree to be bound by the following Terms and Conditions which apply to all users of the site, including without limitation users who are browsers, vendors, customers, and/or Agents.
If you do not agree to all the Terms and Conditions of this agreement, then you may not access the website or use any services. If these Terms and Conditions are considered an offer, acceptance is expressly limited to these Terms and Conditions.
Your submissions of personal information is governed by our Privacy Policy.
2. Definitions
2.1. SIA “NAUTICA”, Reg.No.40103191687, Registered Address: Vizbuļu iela 14, Zvejniekciems, Saulkrastu pag., Saulkrastu nov., LV-2161 (hereinafter referred to as the Company or the Skippercheck).
2.2. Course refers to any online course, or other service that is available to purchase at https://skippercheck.net/, for example, Skippercheck Endrorsement and Skippercheck Basic VHF Radio Operator online course.
2.3. User refers to a person who is using the website to view, and/or purchase, and to study our Courses or other products, or use any other of our Services.
3. General information
3.1. By agreeing to these Terms and Conditions, user represents that user is at least the age of majority in users’ state or province of residence, or user have given us consent to allow any of users’ minor dependents to use this website. If Skippercheck discovers that user has created an account that violates these rules, Skippercheck will terminate user account.
3.2. User needs an account for most of the services on the Skippercheck website. User must keep account password safe and user is responsible for all activity associated with user account. If user suspects someone else is using user account, user must contact Skippercheck.
3.3. When setting up and maintaining user account, user must provide and continue to provide accurate and complete information, including a valid email address. User has complete responsibility for user account and everything that happens on user account, including for any harm or damage (to us or anyone else) caused by someone using user account without user permission.
3.4. User must not submit any material such as general information, facts, comments, opinions, ideas or publications which are defamatory, offensive, menacing, hateful or obscene to the website or which in our judgment may cause nuisance, annoyance, damage or offense, inconvenience to us or any other person or which is illegal. Skippercheck may remove or edit such material from the Skippercheck website at any time without notice to, or consent by user.
3.5. User agrees to not submit false or inaccurate biographical information or information which is not your own accurate CV, logbook and profile information.
3.6. User acknowledges that personal data that user submits for publication through Skippercheck website or crewing services may be available, via the internet, around the world to the users of Skippercheck. Skippercheck cannot prevent the use (or misuse) of such personal data by others.
3.7. When user publishes or shares content or information on Skippercheck, it means that user is allowing users of Skippercheck and other related users, to whom user has shared their profile information, to access and use user profile information or CV information, and to associate it with the user.
4. Our Courses
4.1. Purchase of a Course is a contract between Skippercheck and the user.
4.2. User must have access to the internet and user account to use the Course. It is strongly recommended to ensure that user has the necessary software or compatible devices to access the Courses before purchase.
4.3. Skippercheck Courses are available in English language. Online Courses are available and accessible by the user in the Skippercheck user account for at least one year after the purchase.
4.4. Course prices are displayed on the website https://skippercheck.net/. These prices are inclusive of VAT (unless otherwise indicated), and are subject to change at any time.
4.5. Orders for products and services may be placed once user creates an account on Skippercheck and within account purchases by following the onscreen prompts on our website after clicking on the product/Course you are interested in.
4.6. Payments for Course fees are due, in full, at the time of purchase.
4.7. When you select our Course you will be asked to select your preferred payment method. Payment options include a secure transfer using Stripe.
4.8. Once payment has been made and confirmed users will be supplied with Course information in their Skippercheck account and user will have the access to the online course while user is authorised to Skippercheck profile. After submitting an order to us, user will be sent an order acknowledgement email with your order reference and details of the products/Courses user has ordered.
4.9. Skippercheck will grant user a personal non-transferable licence to use the Courses during the term of your registration. Skippercheck grants user a lifetime access license, except when Skippercheck must disable the course because of legal or policy reasons. The course is not transferable and access is for the applicant/user only. No part of the online documents can be reproduced, stored in or introduced into a retrieval system, or transmitted in any form or by any means, (electronic, mechanical, photocopying, recording or otherwise) or for any purpose, without the express written permission of Skippercheck. Course material should be treated as for any copyrighted material.
4.10. SkipperCheck Basic VHF Radio Operator online course certificate is valid for 5 (five) years after the exam date. Skippercheck Skipper Endorsement is valid for 5 (five) years after issuing the endorsement. Once the certificate expires, certificates are no longer valid and user must refresh their certificates.
5. Course refunds
5.1. Upon purchase, access to the Course is sent immediately to the email address provided by the user and are available from users Skippercheck account.
5.2. Once user has signed into users account to view the Course user purchased, user will lose right to cancel or gain a refund as this will count as 'the service has begun.
5.3. The sale of each Course or any other product is a final, non-exchangeable, non-refundable transaction.
5.4. Skippercheck cannot be held liable if user have purchased the wrong product or Course. If user requires assistance in purchasing the correct item, we ask user to contact Skippercheck and Skippercheck will help user as much as possible. Any replacement purchase will carry a charge.
5.5. If user has not received a login information or product because user has entered an incorrect user details or email address, Skippercheck cannot be held liable for non-receipt of the purchase and a refund will not be given in these circumstances.
5.6. Detailed content descriptions of Courses and other services are freely and widely available from many pages on Skippercheck website. This information gives the user the opportunity to make a well-informed decision about any Course or product that user may wish to purchase. If user is not sure about the content of any course or product, please contact Skippercheck prior to making a purchase.
5.7. If the Course is made available via user Skippercheck account or the Skippercheck account itself is faulty or does not comply with the compatibility specifications stated on our website we may rectify the fault or refund as appropriate in accordance with users legal rights.
5.8. Skippercheck makes all reasonable efforts to ensure that the information contained in our courses is up-to-date and accurate. If user believes that any of our products are inaccurate or incomplete and if, upon investigation, users belief is upheld by Skippercheck, Skippercheck will correct the situation and supply a replacement free of charge. If Skippercheck is unable to correct the situation or there are on-going issues, Skippercheck may issue a refund.
6. Skippercheck liability, errors and inaccuracies
6.1. Skippercheck will not be liable to user where performance of any of our obligations is prevented or restricted by any circumstance or cause beyond our reasonable control.
6.2. User is responsible for the use user makes of the products and services user orders. To the extent not prohibited by law, Skippercheck accepts no liability for any loss which is not reasonably foreseeable or for any business loss (which includes loss of profits, contracts, goodwill, opportunity and other similar losses).
6.3. Occasionally there may be information on our website or in the lessons sold via this website that contains typographical errors, inaccuracies or omissions. Skippercheck reserves the right to correct any errors, inaccuracies or omissions, and to change or update information or cancel orders if any information in the Service or on any related website is inaccurate at any time without prior notice (including after you have submitted your order).
6.4. Skippercheck undertakes no obligation to update, amend or clarify information in the Service or on any related website, including without limitation, pricing information, except as required by law. No specified update or refresh date applied in the Service or on any related website, should be taken to indicate that all information in the Service or on any related website has been modified or updated.
6.5. Skippercheck makes no warranty or representation that this website or lessons and Courses sold via this website will meet user requirements, that it will be of satisfactory quality, that it will be fit for a particular purpose, that it will not infringe the rights of third parties, that it will be compatible with all systems, that it will be secure and that all information provided will be accurate. Skippercheck makes no guarantees of any specific results from the use of our Services.
6.6. Skippercheck does not guarantee, represent or warrant that users use of our service will be uninterrupted, timely, secure or error-free.
6.7. User agrees that from time to time Skippercheck may remove the service for indefinite periods of time or cancel the service at any time, without notice to the user.
7. Severability and termination
7.1. In the event that any provision of these Terms and Conditions is determined to be unlawful, void or unenforceable, such provision shall nonetheless be enforceable to the fullest extent permitted by applicable law, and the unenforceable portion shall be deemed to be severed from these Terms and Conditions, such determination shall not affect the validity and enforceability of any other remaining provisions.
7.2. These Terms & Conditions and the relationship between user and Skippercheck shall be governed by and construed in accordance with the Laws of Republic of Latvia and user agrees to submit to the exclusive jurisdiction of the Courts of Republic of Latvia.
7.3. The obligations and liabilities of the parties incurred prior to the termination date shall survive the termination of this agreement for all purposes.
7.4. These Terms and Conditions are effective unless and until terminated by either you or us. You may terminate these Terms and Conditions at any time by notifying us that you no longer wish to use our Services, or when you cease using our site.
7.5. If in our sole judgment you fail, or we suspect that you have failed, to comply with any term or provision of these Terms and Conditions, we also may terminate this agreement at any time without notice and you will remain liable for all amounts due up to and including the date of termination; and/or accordingly may deny you access to our Services (or any part thereof).
8. Changes to Terms and Conditions
We reserve the right, in our sole discretion, to change the terms of this policy at any time. Any changes are effective immediately upon posting to the website. Continued use of the website constitutes users’ agreement to all such terms and conditions.
